Terms of Use

Moments is made by Love, Cole LLC, a small family-led studio. These terms are the agreement between you and us when you use Moments. We have written them in plain language on purpose: an app that asks for your family’s memories owes you terms you can actually read. By using Moments, you agree to them.
Your memories are yours
Everything you put into Moments — the words, photos, videos, letters, and the story around them — belongs to you. We claim no ownership of any of it. You give us only the narrow permission we need to run the app: to store your content, sync it across your devices, and show it to the people you have chosen to share it with. That permission ends for content you delete.
You can export everything, anytime, for free. That is true whether or not you have ever paid us, and it will stay true.
Your account
Moments accounts are for adults — parents, guardians, and the family members they invite. Information about children in the app is entered and controlled by the adults who own the record. Keep your sign-in method (Sign in with Apple or your email) to yourself; you are responsible for what happens under your account.
Being a good guest in a family’s record
Moments is a private family record, not a public platform. Use it only for lawful purposes and only with content you have the right to share. We may suspend or remove an account that is used to harass, to store unlawful content, or to interfere with the service or other families’ records. We would rather never do this, and in a private, ad-free app there is little reason anyone would make us.
Moments+ (subscription)
Moments+ is an auto-renewing subscription purchased through Apple. Payment is charged to your Apple Account at confirmation of purchase, and the subscription renews unless cancelled at least 24 hours before the end of the current period. You can manage or cancel it anytime in your device’s Settings. Any unused portion of a free trial is forfeited when you buy a subscription. If we ever change a price, existing subscribers are notified by Apple and nothing changes without the notice Apple requires.
If your subscription lapses, nothing you can see in the app is deleted or locked. Your moments and their standard-quality copies remain viewable and exportable, free, forever. Paid limits only ever apply going forward. After a subscription has lapsed, stored full-resolution originals — a Moments+ feature — may be reclaimed following a 90-day grace period with export reminders; the everyday copies you see in the app are kept regardless, and the originals in your own photo library are never touched by us at all.
Founding Families (one-time purchase)
Founding Families is a one-time purchase available to the first 500 purchasing families. It grants all Moments+ features for the operating life of the app, with no subscription.
A promise about forever is only honest if it names the other case, so here it is, in writing. If Moments is ever discontinued:
- You will get at least six months’ notice before the service ends.
- Export of all your content remains free through the end of service — as it always is, for every account.
- Purchases made within the preceding three years will be refunded pro-rata for the remainder of that three-year period, measured from your purchase date to the announced end of service.
Founding Families purchases support Family Sharing, so your Apple family shares the benefits.
Ending your account
You can delete your account anytime, right in the app — no emails, no hoops. Deletion is permanent, so export first if you want a copy. Where a child’s record is shared between adults, deletion follows the choices described in our Privacy Policy.
Honest limits
We work to keep Moments reliable and your memories safe, and the promises above are ones we intend to keep. Beyond them, Moments is provided “as is”: we cannot promise the service will be uninterrupted or error-free, and to the extent the law allows, our total liability for any claim related to Moments is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits rights that your local law does not allow to be limited.
Changes to these terms
If we make a meaningful change, we’ll update the date above and, where appropriate, let you know in the app. Continuing to use Moments after a change means you accept the updated terms. We will never use a terms change to take away ownership of your content or the free export promise.
